Procedures for issuance of liquor wholesale and retail licenses in Vietnam

According to Decree No. 105/2017 / ND-CP dated September 14, 2017 on alcohol business, amended and supplemented by Decree No. 17/2020 / ND-CP dated February 5, 2020, the conditions and procedures for granting wholesale and retail liquor sales permits are as follows:

I. WHOLESALE LIQUOR LICENSE:

Conditions for wholesale liquor sales:

1. Being an enterprise established under the provisions of law.

2. Having a liquor wholesale system in the province, centrally-run city where the enterprise has its head office with at least 01 liquor retailer. In case the enterprise has established branches or business locations outside the head office to sell liquor, there is no need for confirmation from liquor retailers.

3. Having an introduction letter or principle contract of liquor production traders, liquor distribution traders or other liquor wholesalers.

The application for a wholesale liquor sales permit (01 set) includes:

1. Application for a wholesale liquor sales permit according to Form 01 issued together with Decree No. 105/2017 / ND-CP.

2. A copy of the enterprise registration certificate or equivalent legal documents.

3. Documents on the liquor wholesale system include one of the following two types:

a) A copy of the principle contract, confirmation letter or commitment to participate in the liquor wholesale system together with a copy of the liquor retail sales permit of the trader expected to participate in the liquor wholesale system;

b) A copy of the branch operation registration certificate of the enterprise or the business location registration certificate of the enterprise for liquor business.

4. Documents related to liquor suppliers:

a) A copy of introduction documents or principle contracts of domestic production traders, distribution traders or other wholesalers, specifying the types of liquors expected to be suitable for the activities of production traders, distribution traders or other wholesalers;

b) A copy of the liquor production permit, distribution permit or wholesale liquor sales permit of liquor suppliers.

Place of settlement: Provincial Department of Industry and Trade, centrally-run city under central authority.

Settlement time: 15 working days.

Fee: 1,200,000 VND.

II. RETAIL LIQUOR LICENSE:

Conditions for retail liquor sales:

1. Being an enterprise, cooperative, cooperative alliance or business household established under the provisions of law.

2. Having the right to use a fixed business location legally, with a clear address.

3. Having an introduction letter or principle contract of liquor production traders, liquor distribution traders or other liquor wholesalers.

The application for a retail liquor sales permit (01 set) includes:

1. Application for a retail liquor sales permit according to Form 01 issued together with Decree No. 105/2017 / ND-CP.

2. A copy of the enterprise registration certificate, cooperative, cooperative alliance or business household.

3. A copy of the lease / borrowing contract or documents proving the right to use the planned legal retail location.

4. A copy of the introduction letter or principle contract of liquor production traders, liquor distribution traders or other liquor wholesalers.

Place of settlement: Economic Department or Infrastructure Economic Department under the district-level People’s Committee.

Settlement time: 10 working days.

Fee: 1,200,000 VND.
